Can she legally sue me for injuries in an auto accident?

About a week ago ,I got into the dumbest accident. We were both in the right most lane to turn right on the red light. It was dark and she was about to turn but hesitated and stopped at the curviture point of the turn. I thought she went, and the road was pretty clear of the traffic since it was midnight. She was about 5 to 6 ft away from me. I hit my accelerator and hit her. I was ultimately shocked. She set there for the longest crying. The EMT and fire trucks came out. I hit her at about 12-15 mph . My bumper had paint damage and popped out a little bit. Her back bumper had paint damage and her back light was broken due to the impact. She claims that she has hit her head on the steering wheel, which in my mind could only happen if she wasn't wearing a seat belt. The trooper gave me a ticket, which I do deserve. She chose not to go to the hospital, but mentioned that she would be going to a doctor to get checked out. She also claimed that she had injuries from a previous accident that did not heel completely, which is understandable. She claimed that when she hit the steering wheel , her neck bounced back really fast and that she had headaches. My biggest fear is that she will attempt to sue me for injuries, lost wages, medical bills, and loss of happiness. I do have the auto insurance, but the process is going to take forever since the traffic report does not come for 10 days. Any ideas on this matter?

    she could sue you but from what you have told me she would probably lose and you could counter sue for the stress she has caused you and say the accident was her fault. If she sues say you will mount a counter claim and sue her and she should back off or possibly pay you if she is really afraid. Source(s): three law books and my father is a lawyer.

    Yes people that can hit in the rear end can spring their necks etc at just a few miles an hour as you said, not counting the repair of her auto auto insurance. It was just bad luck on your part assuming she wouldnt stop.

    Notify your auto insurance company about the accident.They will do an investigation. If they agree that you are at fault, they will attempt to settle with the other person.Should the other driver decide to hire an attorney and sue you, then your auto insurance company will hire an attorney to defend you.If you get suit papers, you need to immediately get them to your auto insurance adjuster. The adjuster will need to know the date/time you got the papers and how (certified mail or process server). The adjuster will then forward the papers to an attorney to defend you.     This is why the auto insurance companies make big bucks. Turn the case over to your auto insurance company, do what they ask you to do, and the whole thing will be over before you know it. Oh, and pay your traffic ticket (if the auto insurance company tells you to).

    I would contact your auto insurance company and have them help you deal with this matter. The other driver most definitely can sue you for medical damages as a result of this crash since it was your fault. Your auto insurance company should take auto auto insurancee of her medical bills and damage to her vehicle. That is why you pay the premiums.

    Sure, she could sue you for the moon. That doesn't mean she'll get it. She'll need to prove all her injuries via doctor reports/photographs, etc, and she'll have to prove they happened due to the accident.
