Should I hire an attorney to help me fight a claim of $40,000 against me?

I got in an at-fault auto accident in 2004…I had no auto insurance at the time. The opposing party sued his auto insurance company and I went in for a deposition to support his case about 3 years ago. Now, his auto insurance company is charging me the $40,000 they had to fork out for bodily injury done to the opposing party. The auto insurance company has not sued me yet but have threatened to take me to court unless I start paying off this $40,000. Unfortunately, I cannot afford this. I was told that because so much time has lapsed since the auto insurance company may decide to "sue" me, their claim may be null and void. Is this true? Do you think that if I decide to hire an attorney to fight it would be worth it?

Best Answer – Chosen by Voters i know how you feel..lucky for you, you got some options..I don't even have any optionsI believe you should either learn to do it yourself or hire a paralegal or attorney.I personally think that you should hire somebody just incase you might do it all wrong.Goodluck

An attorney might get the amound adjusted down for you a bit but thats the way Ins company work. They will sue the other party to recoup their losses. In your case you were at fault so they will make you pay for it. Sorry to give ya bad news but thats the way it work. You can call an Ins Company in your area and ask the agent if that legal in your State. Thats the way it works in IL.

The issue for that lawyer will turn on the statute of limitations. That will depend on the nature of the claim against you and the law of your state or country. I have no idea if it can work because I do not know what state or country governs and I do not know the nature of the claim. If you want a real answer, consult an attorney. If you want baseless opinions from people who do not even know what state or country you are in, this is the place.

You should at least consult with an attorney. Many will offer first consultation for free.
